HR documentation process for Test Preparation Platforms: educator and writer agreements, confidentiality and ownership of material
Test preparation runs on material that belongs to someone: recorded lectures, question banks and answer keys. Clear agreements say who owns what and who may see unreleased papers.

Agreements with educators are often informal because the relationship started with a friendly call. Then a rival offers a better deal, the educator wants to reuse the recordings elsewhere and the platform finds its only evidence is a chat thread. Question writers face the same: no one is sure who owns the bank they built.
The paper can be simple. An agreement for each educator and writer covering the basis of payment, the term, ownership and reuse of material, confidentiality of unreleased papers and what happens when either side leaves. A file for each person with signed copies and a log of material they delivered. A qualified professional should review the main clauses.
How to set it up
1. Draft standard agreements
One for educators, one for question writers, one for doubt solvers. Use plain words and keep each to two or three pages.
2. State the basis of payment clearly
Fee, share of sales, salary or per-question rate, with the dates of payment and the reporting provided.
3. Settle ownership and reuse
Say who owns recordings, question banks and notes, whether the person may use them elsewhere and for how long the platform may keep selling them.
4. Add a confidentiality page
What counts as confidential, who may see it, where it is stored and what to do on a leak. Each person signs a copy.
5. Keep a delivery log and file
For each person, the agreement, ID, delivery log of lectures or questions and any correspondence on changes.
Check these first
Before changing anything, find out what is true today. These take an afternoon and use your own records.
- Pick your top five educators and see whether each has a written agreement.
- Ask who owns your largest question bank and find where it is written.
- Check whether everyone with access to unreleased papers has signed a confidentiality page.
- Compare a writer's delivery log with their last payment.

Questions owners ask
Restrictions on moving have legal limits, and the rules depend on the facts. Ask a qualified professional what is sensible to include. Fair terms and good treatment keep educators better than a clause alone.
It should be set out in the agreement before work starts. Many platforms own the bank and allow writers to reuse their own methods. Have a qualified professional check the wording.
Have a written plan: who investigates, who is told, what is paused and what is said to students. Practise it once a year. Take advice on any steps involving legal action.
